Michel of the U.S. Court of Appeals for the Federal Circuit, was in residence for four days as our Visiting Distinguished Judicial Fellow. The residence, sponsored by Cooper & Dunham, allowed him to meet with students, lunch with faculty, teach a Patents class, and deliver a public lecture on "Innovation, Incentives, Competition, and Patent Law: Should Congress Leave Patent Management to the Courts?" 2) On December 2, 2009, the Institute held a panel discussion in conjunction with the Fordham Corporate Law Center. The topic was Pharma: Key Legal and Business Issues. Business strategy in the pharmaceutical industry is subject to numerous constraints, not least of which are the legal and scientific exigencies associated with patenting new drugs (and "evergreening" existing drugs). The panel addressed these constraints, and explored how concerns relating to patents influence near- and long-term business strategies. What is the effect of proposed Hatch-Waxman legislation on continued development and marketing of biologics? What is the economic impact of generic manufacturers' "launch at risk" strategies? How are patent litigation strategies affecting long-term business decisions in the industry? How does the declining number of patents affect the long-term viability of generic manufacturers? Legal and business manufacturers from across the pharmaceutical industry discussed these issues. 3) On January 19th, Japanese Judge Kenji Shinoda talked with sponsors of the Intellectual Property Law & Policy Conference on matters involving patent litigation in the U.S. and Japan -- the use of court-appointed experts, the duties of special masters, nad the relative expertise of judges.
